INTROMEDIC WINS PATENT INFRINGEMENT LAWSUIT AGAINST
GIVEN IMAING IN GERMANY

Given Imaging Ltd. (NASDAQ: GIVN), a global leader in capsule endoscope industry filed a patent infringement lawsuit in Dusseldorf, Germany against competitor, IntroMedic Co. Ltd. Of South Korea (CEO, Hanbo Shim) in November 2009, through its local partner Medwork Medicinal Products and Services GmbH for European Patent EP 1 418 833 (833’) EP 1 474 927 (927’), and the German utility model DE 201 22 489 (489’).
IntroMedic filed to invalidate and unregister 2 patent infringements and 1 utility model in March 2010 and January 2011 with patent evidence voiding Given Imaging’s patents.
In August 2011, the German Patent and Trademark office and the Federal Patent Court of utility model cancelled the registration of 489’. In October 2012, European Patent voided Given’s 833’. Finally, January 2013, Federal Patent Court a final void judgment was announced for patent 927’.
